# Terms of Service **Seller:** ServerQuay, the public trading name of ServerHarbor. Before checkout is enabled, the seller must publish its full legal business identity, physical or registered address where required, and a working support/contact route. ServerQuay is not affiliated with or endorsed by Mojang, Microsoft, or any game publisher. ## 1. Scope and acceptance These terms govern access to the ServerQuay website, account, and any game-server hosting subscription bought from ServerQuay. By placing an order, you agree to these terms and the applicable plan details. If you do not agree, do not order. The order confirmation and the product description shown at checkout form part of the agreement. Mandatory rights under consumer law are not waived. ## 2. Eligibility and account security The account holder must be at least 18 or the age of legal majority where they live, whichever is higher. The service is not marketed to children. Keep account credentials private, use accurate account information, and tell support promptly if you suspect unauthorized access. You are responsible for activity through your account except where applicable law says otherwise. ## 3. Subscription, price, and renewal A subscription is billed monthly at the price and currency displayed before you submit payment. It renews automatically for successive monthly periods until cancelled. Checkout must state the total recurring price, billing interval, taxes where applicable, and cancellation route before purchase. We will not charge a price increase without advance notice and any consent required by law. A third-party payment processor handles payment; ServerQuay does not ask you to send card details by email or support chat. ## 4. Service and supplier dependency The service is managed game-server hosting provided using third-party infrastructure and provisioning suppliers. Available games, versions, regions, server specifications, modpacks, backups, and controls are limited to what is expressly shown as currently supported at checkout. We will not promise a feature, compatibility, capacity, or uptime unless it is specifically stated and substantiated. A supplier outage, maintenance, or capacity limit may affect service. We will use reasonable efforts to communicate material disruptions and address support requests. Nothing in these terms excludes remedies that consumer law requires. ## 5. Customer responsibilities and acceptable use You must comply with the Acceptable Use Policy, game publisher rules, and applicable law. You are responsible for the content and configuration you upload, your users’ conduct, and obtaining rights to use software, maps, mods, and other materials. Do not use the service for unlawful conduct, infringement, malware, attacks, or activity that harms other customers or systems. We may investigate credible reports and restrict access as described in the Acceptable Use Policy. ## 6. Cancellation, refunds, and withdrawal rights You can cancel through the self-service account controls or the support route stated before checkout. Cancellation stops future renewal and normally takes effect at the end of the already-paid billing period; access may continue until then. Cancellation does not remove any statutory right to withdraw, receive a refund, or obtain a remedy. Refund eligibility, including any rights for digital services or services that are faulty or not as described, is set out in the Refund and Cancellation Policy and applicable law. If immediate provisioning affects a statutory withdrawal right, checkout must obtain any legally required express request and acknowledgement. ## 7. Suspension and termination We may restrict or suspend a service where reasonably necessary to address a security risk, serious abuse, non-payment, unlawful activity, supplier direction, or material breach. Where practicable, we will give notice, explain the reason, and allow a reasonable opportunity to correct the issue. We may act immediately where delay risks harm, evidence destruction, or legal violation, and will review the action promptly. You may cancel at any time. Any refund due on termination will be assessed under the refund policy and mandatory law. ## 8. Intellectual property You retain rights in your content. You grant ServerQuay and its suppliers only the limited permission needed to store, transmit, back up, and operate that content for the service and support you request. ServerQuay’s original site materials remain its or its licensors’ property. Game and mod names belong to their respective owners and are used only to identify compatibility; no publisher endorsement is implied. ## 9. Privacy and security Our Privacy Notice explains how account, payment-related, support, and service information is handled. We use appropriate safeguards, but no online service can guarantee absolute security. Please do not submit sensitive personal data unless it is necessary and requested through an appropriate channel. ## 10. Liability and consumer rights Nothing in these terms excludes or limits liability where the law does not permit it, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, or mandatory consumer remedies. Subject to those limits, ServerQuay is not responsible for indirect losses that were not reasonably foreseeable. To the extent permitted by law, our total liability for a claim concerning a paid subscription is limited to the amount you paid us for that subscription in the three months before the event giving rise to the claim. This limit does not reduce statutory rights. ## 11. Changes and governing law We may update these terms for legal, security, or service reasons. We will give reasonable notice of material changes; changes will not retroactively remove accrued rights. The law of the seller’s place of establishment applies, subject to mandatory consumer protections in your country. The seller’s establishment and contact particulars must be disclosed before checkout. Courts with jurisdiction under applicable law may hear disputes. You may also use any consumer complaint or dispute-resolution route available by law. ## 12. Contact Contact ServerQuay through the support route published on the service.
